{"id":57,"date":"2021-12-07T13:44:28","date_gmt":"2021-12-07T13:44:28","guid":{"rendered":"https:\/\/mqaweb.com\/FloridaTakeControl\/?page_id=57"},"modified":"2025-02-14T15:42:34","modified_gmt":"2025-02-14T15:42:34","slug":"controlled-substances-bill","status":"publish","type":"page","link":"https:\/\/flhealthsource.gov\/FloridaTakeControl\/controlled-substances-bill\/","title":{"rendered":"Controlled Substances Bill"},"content":{"rendered":"\r\n<style>\r\nh6 {text-decoration:underline; margin-bottom:-3px;}\r\n<\/style>\r\n\r\n<div class=\"page-container\">\r\n<h4 style=\"text-align:center;\">Take Control of Controlled Substances<\/h4>\r\n\r\n<h5 style=\"text-align:center; margin-top:-3%;\">(Chapter 2018-13, Laws of Florida)<\/h5>\r\n\r\n<p>In 2018, Florida passed the Controlled Substances Bill that establishes prescribing limits, requires continuing education on controlled substance prescribing, expands required use of Florida&rsquo;s Prescription Drug Monitoring Program, EFORCSE, and more.<\/p>\r\n\r\n<h6>Required Continuing Education<\/h6>\r\n\r\n<p>Each prescribing practitioner who is registered with the United States Drug Enforcement Agency, is required to take a Board-approved continuing education course, unless the practitioner is already required to complete such a course under his or her practice act.<\/p>\r\n\r\n<p>The course must be completed by January 31, 2019, and at each subsequent licensure renewal.<\/p>\r\n\r\n<h6>Prescription limits for Acute Pain<\/h6>\r\n\r\n<p>A prescribing practitioner may prescribe or dispense up to a 3-day supply of a Schedule II opioid to alleviate acute pain. However, a prescribing practitioner may prescribe or dispense up to a 7-day supply for acute pain if the physician determines:<\/p>\r\n\r\n<ul>\r\n\t<li>more than a three-day supply is needed based on the professional judgement of the prescriber;<\/li>\r\n\t<li>indicates &quot;acute pain exception&quot; on the prescription, AND<\/li>\r\n\t<li>documents the justification for deviating from the 3-day supply limit in the patient&#39;s medical record<\/li>\r\n<\/ul>\r\n\r\n<h6>Prescriptions for Nonacute Pain<\/h6>\r\n\r\n<p>If the prescriber writes a prescription for a Schedule II opioid for the treatment of pain other than acute pain, the prescriber must indicate &quot;Nonacute Pain&quot; on the prescription.<\/p>\r\n\r\n<h6>Pain Management Clinics<\/h6>\r\n\r\n<p>All pain management clinics must be registered with the Department of Health as a pain management clinic or hold a certificate of exemption by January 1, 2019.<\/p>\r\n\r\n<p>An applicant for a certificate of exemption must provide:<\/p>\r\n\r\n<ul>\r\n\t<li>The name or names under which the applicant does business;<\/li>\r\n\t<li>The address at which the pain management clinic is located;<\/li>\r\n\t<li>The specific exemption that the applicant is claiming, along with supporting documentation; AND<\/li>\r\n\t<li>Any other information DOH deems necessary.<\/li>\r\n<\/ul>\r\n\r\n<p>&nbsp;<\/p>\r\n\r\n<p>Each certificate must be renewed biennially, be prominently displayed, and made available to the DOH or applicable board upon request.<\/p>\r\n\r\n<h6>Prescription Drug Monitoring Program<\/h6>\r\n\r\n<p>Each prescriber and dispenser or his\/her designee has a duty to consult the PDMP system to a patient&#39;s controlled substance dispensing history each time a controlled substance is prescribed or dispensed to a patient age 16 or older unless a statutory exemption applies.<\/p>\r\n\r\n<p>There is required consultation of the PDMP except:<\/p>\r\n\r\n<ul>\r\n\t<li>Patient is less than 16 years of age<\/li>\r\n\t<li>Drug being prescribed is a nonopioid Schedule V<\/li>\r\n\t<li>System is not operational<\/li>\r\n\t<li>Requestor has technological or electrical failure<\/li>\r\n<\/ul>\r\n\r\n<p>&nbsp;<\/p>\r\n\r\n<p>Failure to consult the PDMP may result in a non-disciplinary citation by the regulatory board or further discipline.<\/p>\r\n\r\n<p>You may register for the PDMP at: <a href=\"https:\/\/florida.pmpaware.net\/login\" target=\"_blank\" rel=\"noopener\">florida.pmpaware.net\/login<\/a><\/p>\r\n\r\n<p style=\"margin-bottom:3%;\"><!-- Leave This Here -->&nbsp;<\/p>\r\n<\/div>\r\n\r\n","protected":false},"excerpt":{"rendered":"<p>Take Control of Controlled Substances (Chapter 2018-13, Laws of Florida) In 2018, Florida passed the Controlled Substances Bill that establishes prescribing limits, requires continuing education on controlled substance prescribing, expands required use of Florida&rsquo;s Prescription Drug Monitoring Program, EFORCSE, and more.
